By accessing or using ModernRx's telehealth services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services. You must be at least 18 years of age to use ModernRx.
ModernRx provides asynchronous text-based telehealth consultations with board-certified physicians. Our services include medical consultations, prescription management, and generation of medical documentation such as doctor's notes. Services are provided at a flat fee of $40.00 per visit. No insurance is required or accepted.
ModernRx is not a substitute for emergency medical care. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately. Our services are designed for non-emergency medical conditions. The physicians on our platform exercise independent medical judgment and may decline to treat certain conditions that require in-person examination.
By using ModernRx, you consent to receiving healthcare services via telehealth. You understand that telehealth involves the communication of your medical information using electronic means. You acknowledge that telehealth has potential risks including, but not limited to, interruptions in service, delays in evaluation, and the inability to perform a physical examination. You have the right to withdraw your consent at any time.
Each visit costs a flat fee of $40.00, payable at the time of service. Payments are processed securely through Stripe. Refunds may be issued at our discretion if a physician is unable to provide a consultation. We do not bill insurance companies and do not accept insurance payments.
Our physicians may prescribe medications at their professional discretion. We do not prescribe controlled substances (Schedule II-V). Prescriptions are sent electronically to your designated pharmacy. It is your responsibility to provide accurate pharmacy information. ModernRx is not responsible for pharmacy availability or medication pricing.
You agree to provide accurate and complete medical information, use the platform only for legitimate healthcare purposes, maintain the confidentiality of your account credentials, and not share your account with others. You are responsible for all activity that occurs under your account.
To the maximum extent permitted by law, ModernRx and its physicians shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid for the specific visit giving rise to the claim.
These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
